Rape is any sexual penetration that takes place without consent.
Dictionary Definitions
Unlawful sexual activity and usually sexual intercourse carried out forcibly or under threat of injury against a person’s will or with a person who is beneath a certain age or incapable of valid consent because of mental illness, mental deficiency, intoxication, unconsciousness, or deception.
Unlawful sexual intercourse or any other sexual penetration of the vagina, anus, or mouth of another person, with or without force, by a sex organ, other body part, or foreign object, without the consent of the victim.
A Deeper Look
- Any kind of penetration that happens without consent is considered rape. This includes vaginal, oral, and anal penetration by genitalia, foreign objects, or other parts of the body such as fingers.
- Lack of consent can include physical force or coercion. You cannot give consent if you are unconscious, intoxicated or incapacitated.
